Terms of Service
These Terms of Service ("Terms") govern access to and use of the Government Operations and Performance System (GovOps) (the "System") operated by the Municipality of Solano (the "LGU").
By accessing or using GovOps, you acknowledge these Terms and agree to comply with them, applicable laws, government rules and regulations, and applicable policies, memoranda, office orders, and security requirements of the Municipality.
If you are not authorized to use GovOps, you must not access or use the System.
1. Acceptance of Terms
Access to or use of GovOps constitutes acknowledgment of these Terms and the applicable GovOps Privacy Policy.
These Terms apply together with applicable Philippine laws, Civil Service rules and regulations, government records-management requirements, LGU policies, memoranda, office orders, and other rules applicable to the user's official duties.
Where a specific law, government regulation, office order, or LGU policy imposes a requirement that differs from these Terms, the applicable law or official rule shall prevail.
2. Eligibility and Authorized Access
GovOps is intended for authorized LGU personnel and other users who have been granted access by the Municipality.
Accounts may be created through administrator-controlled provisioning, invitation, registration, or other authorized procedures implemented by the System.
Access is controlled according to assigned roles and permissions. You may access only the units, tasks, records, files, reports, and features that your assigned role and permissions authorize.
You must not access, attempt to access, modify, disclose, copy, download, or otherwise use information beyond your authorized permissions, even if a technical configuration or system error makes such access possible.
Discovering a technical gap or unintended access does not grant authorization to use it.
3. User Accounts
When using GovOps, you must:
- Provide accurate information when registering or maintaining an account;
- Keep account information reasonably current;
- Protect your password, authentication codes, and other credentials;
- Never share your credentials or allow another person to use your account;
- Never use another person's account or credentials;
- Sign in only through authorized authentication methods;
- Follow applicable password and authentication requirements; and
- Promptly report suspected unauthorized access or compromise of your account.
Where enabled, users may authenticate through a Google account that has been authorized or provisioned for GovOps.
The Municipality may require password changes, verification, or other authentication measures as part of account security.
4. User Responsibilities
You are responsible for activity performed through your account to the extent permitted by applicable law and subject to the Municipality's investigation and security procedures.
You are also responsible for:
- Providing accurate and complete information;
- Ensuring that submitted reports, remarks, forms, and records are accurate to the best of your knowledge;
- Uploading only files you are authorized to submit;
- Following applicable LGU policies and procedures;
- Protecting confidential and personal information accessed through GovOps; and
- Promptly reporting suspected errors, security incidents, unauthorized access, or misuse.
5. Acceptable Use
GovOps may be used only for authorized government and administrative purposes.
Permitted activities may include:
- Creating and managing government tasks;
- Completing assigned work;
- Submitting Daily Accomplishment Reports (DAR);
- Submitting Weekly Accomplishment Reports (WAR);
- Submitting authorized requests and forms;
- Uploading task-related supporting files;
- Reviewing information within assigned permissions;
- Receiving official notifications; and
- Performing other activities expressly authorized by the Municipality.
Use of GovOps for unrelated personal, commercial, or unauthorized activities is prohibited.
6. Government Records and Work Products
Information, documents, reports, forms, and other records created, submitted, stored, or processed through GovOps may constitute official government records or work products of the Municipality.
Such records are not the personal property of individual users merely because a user created, uploaded, or submitted them.
Records may be reviewed, processed, approved, returned, rescheduled, archived, retained, or otherwise handled by authorized personnel according to applicable government procedures, LGU policies, records-management requirements, and the System's configured workflows.
Users must not intentionally falsify, conceal, improperly alter, destroy, or remove official records.
7. Uploading and Handling Files
Users must upload only files that:
- Are relevant to an authorized government activity;
- The user is authorized to submit;
- Do not knowingly contain malicious software; and
- May lawfully be processed by the Municipality.
Users must not knowingly upload malware, unlawful content, unauthorized personal information, or material that infringes the rights of another person.
Depending on the feature and configuration, uploaded files may be stored in the System's database or file-storage infrastructure, including Google Drive services.
Files may be processed by GovOps for functions such as previews, document handling, text extraction, or other features implemented in the System.
Users must not download, copy, forward, publish, or otherwise distribute files obtained through GovOps outside authorized government purposes or applicable LGU procedures.
8. Confidentiality Responsibilities
Information accessible through GovOps may include personal information, confidential government information, internal work records, and other non-public information.
Users must:
- Keep confidential information secure;
- Use information only for authorized purposes;
- Access information only when necessary for their official duties;
- Not disclose information to unauthorized persons;
- Not publish confidential information through social media or other public channels; and
- Follow applicable LGU confidentiality, security, and data-protection requirements.
Confidentiality obligations may continue after an account is deactivated or a user's employment, appointment, assignment, or engagement with the Municipality ends, to the extent required by applicable law or policy.
9. Task and Workflow Processing
GovOps may use staged workflows for government tasks, requests, reports, and related records.
Depending on the feature, records may pass through stages such as assignment, acceptance, completion, review, approval, return, rescheduling, or archival.
Status changes, actions, approvals, remarks, and other significant events may be recorded together with the responsible user and relevant date and time.
Users must perform actions only within the stages and decisions authorized by their assigned role.
Users must not intentionally manipulate workflow status, timestamps, approvals, or other system records outside their authorized functions.
10. Electronic and Digital Signatures
Where GovOps provides functionality for drawing, uploading, applying, or otherwise using an electronic or digital signature or stamp, users must use such functionality only in accordance with their official authority and applicable LGU procedures.
A user must not:
- Apply another person's signature without authorization;
- Allow another person to use their signature credentials or signing authority;
- Misrepresent who approved or signed a record;
- Copy or reuse a signature for an unauthorized purpose; or
- Circumvent required approval or signing procedures.
Electronic or digital signatures used through GovOps are subject to applicable Philippine laws, government rules, LGU policies, and the specific requirements applicable to the document or transaction.
The use of a signature feature in GovOps does not, by itself, determine the legal validity or evidentiary effect of a particular document. Applicable law and the Municipality's authorized procedures govern.
11. Prohibited Activities
Users must not:
- Access another user's account;
- Access information outside their assigned permissions;
- Circumvent authentication, account lockouts, rate limits, access controls, or other security mechanisms;
- Probe, scan, test, or attempt to compromise GovOps security without written authorization;
- Introduce malware, malicious code, or other harmful content;
- Interfere with the availability or operation of GovOps;
- Intentionally falsify, alter, conceal, or improperly delete records, timestamps, signatures, reports, or audit information;
- Impersonate another user;
- Use GovOps for unauthorized personal, commercial, political, fraudulent, or unlawful activities;
- Conduct unauthorized automated scraping, bulk extraction, or systematic collection of information;
- Attempt to reverse engineer or circumvent technical controls except where expressly permitted by applicable law and authorized by the Municipality; or
- Use GovOps to violate the rights, privacy, security, or lawful interests of another person or organization.
12. Account Suspension and Termination
The Municipality may restrict, suspend, lock, or deactivate an account where reasonably necessary, including because of:
- Suspected unauthorized access;
- Security risks;
- Violation of these Terms;
- Misuse of the System;
- Changes in assignment or role;
- End of employment, appointment, or authorized engagement;
- Administrative requirements; or
- Other legitimate operational or legal reasons.
Accounts may also be temporarily locked following repeated unsuccessful authentication attempts as a security measure.
Where appropriate, the Municipality may investigate suspected misuse and may refer matters to the appropriate office or authority.
Violation of applicable laws, regulations, or government policies may result in administrative, civil, or criminal consequences, as applicable.
Deactivation of an account does not necessarily result in deletion of records associated with that account. Records may be retained when required for government, audit, legal, security, or records-management purposes.
13. System Availability
GovOps is provided for official government operations and is made available on an as-available basis.
The Municipality does not guarantee that the System will always be uninterrupted, error-free, or available at all times.
Temporary interruptions may occur because of:
- Scheduled maintenance;
- Emergency maintenance;
- Network or connectivity problems;
- Server or infrastructure issues;
- Security incidents;
- Third-party service outages;
- Google Drive or authentication service interruptions;
- Email or notification service issues; or
- Events outside the Municipality's reasonable control.
Users should follow official instructions when GovOps or specific features are placed under maintenance.
14. Maintenance and System Updates
The Municipality may modify, update, restrict, suspend, or discontinue individual GovOps features when necessary for:
- System maintenance;
- Security;
- Performance improvements;
- Bug fixes;
- Infrastructure changes;
- Legal or regulatory requirements;
- Changes in government procedures; or
- Other legitimate operational purposes.
Maintenance may affect only particular features rather than the entire System.
The Municipality may provide advance notice where reasonably practicable, but emergency maintenance or security-related changes may occur without advance notice.
15. Intellectual Property and System Ownership
GovOps, including its software components, interface design, system structure, logos, branding, and other materials created specifically for the System, may be owned by, licensed to, or otherwise used with authorization by the Municipality or the relevant rights holders.
Nothing in these Terms grants users ownership of the GovOps software, source code, interface, branding, or other protected system materials.
Users must not copy, modify, redistribute, reverse engineer, sell, sublicense, or commercially exploit GovOps or its protected materials except where expressly authorized or permitted by applicable law.
Government records and work products created or maintained through official duties remain subject to applicable laws, government policies, employment rules, and records-management requirements.
16. Government Records, Retention, and Audit
Records and information processed through GovOps may be subject to applicable:
- Government records-management requirements;
- Audit requirements;
- Archival requirements;
- Data-protection requirements;
- Legal preservation requirements; and
- Other applicable government rules.
Records, audit logs, and other information may therefore be retained after a user's account has been deactivated or their authorized access has ended.
Where legally required or authorized, records may be made available to appropriate government offices, oversight bodies, auditors, courts, or other authorized authorities.
Nothing in these Terms creates an independent obligation to disclose records where disclosure is not required or permitted by applicable law.
17. Security
The Municipality implements reasonable and appropriate administrative, physical, and technical measures to protect GovOps and the information processed through it.
These measures may include:
- Role-based access control;
- Authentication controls;
- Password protection and secure password hashing;
- Session controls;
- Account lockout mechanisms;
- Activity and audit logging;
- Restricted administrative access;
- File-access controls; and
- Other security measures appropriate to the risks associated with the System.
No electronic system can be guaranteed to be completely secure.
Users must also contribute to system security by:
- Protecting their credentials;
- Signing out when using shared devices;
- Not sharing authentication codes;
- Avoiding unauthorized access;
- Reporting suspected security incidents promptly; and
- Following applicable LGU information-security policies.
User sign-in and relevant System activities may be logged for security, auditing, accountability, and operational purposes as described in the GovOps Privacy Policy.
18. Disclaimer and Limitation of Liability
To the fullest extent permitted by applicable Philippine law, the Municipality does not guarantee that GovOps will be continuously available, completely error-free, or free from all security risks.
To the extent permitted by law, the Municipality is not responsible for losses arising solely from:
- Temporary system unavailability;
- Network or connectivity failures;
- Third-party service interruptions;
- Errors or omissions in information entered by users;
- Unauthorized access resulting from a user's failure to protect their credentials; or
- Events outside the Municipality's reasonable control.
Nothing in these Terms excludes, restricts, or limits any liability, responsibility, right, or remedy that cannot lawfully be excluded or limited under Philippine law.
Nothing in this section relieves the Municipality of its obligations under applicable data-protection, government, records-management, or other laws.
19. Changes to These Terms
The Municipality may update these Terms when necessary to reflect:
- Changes to GovOps;
- New or modified system features;
- Changes in government procedures;
- Changes in applicable laws or regulations;
- Security or operational requirements; or
- Other legitimate administrative requirements.
The Last Updated date at the beginning of these Terms identifies the current version.
Where appropriate, material changes may be communicated through GovOps or other official LGU communication channels.
The updated Terms become effective on the date specified by the Municipality or, if no specific effective date is stated, upon publication through the System.
20. Governing Law
These Terms are governed by the laws of the Republic of the Philippines, including applicable provisions of:
- Republic Act No. 10173, the Data Privacy Act of 2012;
- Republic Act No. 8792, the Electronic Commerce Act of 2000; and
- Other applicable Philippine laws, regulations, government rules, and NPC issuances.
Any dispute or legal matter relating to these Terms shall be handled by the appropriate government authorities or courts having lawful jurisdiction over the matter and the Municipality of Solano, subject to applicable Philippine law and rules on jurisdiction and venue.
